Most personal injury claims in Ontario are subject to a two-year limitation period from the date you knew or ought to have known about your injury and its cause. However, shorter notice deadlines can apply, particularly for slip and fall cases on municipal property and/or private property and for accident benefits. Missing a deadline can seriously affect your ability to claim compensation.

Accident benefits claims have their own, much shorter deadlines. You generally must notify your insurer within 7 days of the accident, and once your insurer sends the application package, you have 30 days to submit the completed OCF-1 form. Missing these early deadlines does not automatically disqualify you, but a reasonable explanation is required, so it is best not to rely on that exception.

Claims involving traumatic brain injuries, spinal injuries, or multiple fractures often require more time because the full extent of the disability, future care needs, and loss of earning capacity must be properly established before settling. Insurers typically want clear medical evidence of your recovery outlook before agreeing to a full and final settlement.
